Dealing with snow and ice is complicated and inherently risky. Contractors can face insurance claims and even legal liability for property damage or bodily injury if they don’t take proper precautions. Before the first flakes of the season hit the ground, take a moment to review your contracts and work practices. We’ve put together some tips to help you.

Snow and ice service contractors have two major types of claims: Pedestrian slip/fall cases and property damage.

Implementing sound work practices provides the best defense against claims:

  • Have a site plan developed before the winter season begins.
  • Document and photograph site conditions before they’re buried in snow and ice.
  • Do good quality work.
  • Remove the snow and ice promptly and thoroughly in accordance with the site plan.
  • Don’t bury cars or fire hydrants in snow.
  • Don’t plow snow onto sidewalks.
  • Do what the contract says you will do.

Planning
Good site plans have several key elements:

  • Identify snow storage sites in advance — Document and photograph pre-existing pavement and landscape conditions
  • Consider slope and drainage routes for stored, melting snow
  • Flag or otherwise mark hazards that may be buried or obscured by deep snow
  • Determine how or when snow obscured by parked automobiles will be removed
  • Have specific plans for clearing handicapped parking spaces and adjacent areas designated for access by disabled persons, as these individuals are at higher risk of injury due to icy surfaces and deep snow
  • Include a site map (drawing, sketch or marked up satellite photo) to designate storage locations and identify details such as drains and existing potholes or pavement damage

Other items to consider include:

  • Allowing for downspout drainage
  • Elevated obstacles
  • Gravel lots and low spots that can be difficult to manage with a snow blade

Placement of snow storage piles is important. Poorly placed piles can create liability for the contractor. It’s best to have the owner specify where the piles should be placed and be sure that piles are not:

  • Obstructing driver vision at intersections
  • Blocking storm drains
  • Placed on high spots where runoff from melting snow can wet down large downhill areas that become unintended skating rinks when a refreeze occurs

Contractors should be certain that they have enough manpower and equipment to effectively manage snow removal even in cases of extreme cold or abnormally large snowfall amounts in a short period of time. Remember that abnormal events can make it necessary to haul snow off site.
